for a counter offer. the white house said that is not serious, we are waiting for a offer from the republicans. tim geithner was on cnbc yesterday and asked whether or not the federal government is preparing to go off the fiscal cliff in particular this administration. he answered unfortunately in the affirmative. here's tim. >> if republicans do not agree to that is the administration prepared to go over the fiscal cliff. >> we face no prospect of agreement that doesn't involve the rates going up on the top two percent. >> brian: he also said he believes that the president needs to get control of the debt limit. that is a nonstarter. there is no way to get congress to give up control of debt limit. >> steve: republicans are saying let's cave and surrender on the tax issue.

but coming up in 2013 we have leverage over the debt limit. remember the president of the united states his personal approval ratings went in the toilet. >> brian: as is the congress. >> steve: the congress didn't have as far to because they were close to the floor anyway. republicans say let's have leverage next time and the president said let's take that off of the table and from now on the president doesn't have to negotiate from congress. congress doesn't like that one bit. >> gretchen: usually when you are holding the cards in the negotiation you don't have to budge. that's the position the president and time geithner feel. they feel they hold the cards and they won the election and they believe the american poll believe the rich should be taxed more. that's why they are holding firm. i found it interesting that they floated out the leaks to

the press yeah, the president would be willing to go over the fiscal cliff and then he sent out his guy tim geithner in the interview and answer almost before the question was finished being asked. we are willing to go over the fiscal cliff. why? to square the members to call their members of congress. if you talk to business people and people in the banking industry they are not concerned about the fiscal cliff and i am not sure why. maybe they feel it is going to get done. this is very, very interesting. >> steve: i think there are people who are optmistic that something can happen in the long run. >> brian: we get past this hurdle and we might get on a roll. >> steve: john boehner said

the republicans point of view. we don't have to raise rates on the top people. we can tighten things up and close the loop holes and deduction. actually that the president of the united states's point of view back last year . now he said it is all about tax rates. this is the president in a flash back. >> what we said give us 1.2 trillion in additional revenues which could be accomplished without hiking tax rates, but could simply be questioned by eliminating loop holes and deductions and engaging in a tax reform process that could have lowered rates. >> steve: he was for closing loop holes employ. >> gretchen: but that rhetoric doesn't fit in. >> steve: he destroys his

argument today. >> gretchen: does it matter? politicians say one thing one day and another the other day. that is unfortunate. >> brian: i don't think it -- >> gretchen: it was about the one percent and 99 percent and not about closing loop holes. >> steve: they say one thing last year and another thing. >> gretchen: he's keeping with the cam on -- campaign message. one percent and 99 percent and that is why he is going full steam ahead with raising tax rates. >> brian: you can say i don't believe closing loop holes don't do something. you said in 2011 it would. bill o'reilly talked to marco rubio a star on the republican side. he said 85 billion a year if rates go up to 39 percent. it is nothing but symbolic, listen.

>> my parents worked in the service industry and beaut a house. we always had more than we needed thank god and thank this country. it is only going to be possible in the future if we have limited government and free enterprise. people come here from all over the world to get rid of big government. i don't understand why we don't do a better job of lay out. i hope to be one of a multile voice to make that argument. it is the only way forward. we'll never be able to raise taxings. you can't generate enough. we need new taxpayers. >> gretchen: we didn't get our message out effectively enough. that is so true. the republicans actually have a legitimate message when it comes to the fact. if we increase taxings democrats have to cut entitlements. somewhere it gets lost in the shuffle.

we ard from the president if we communicated better you would like my plan. what about the republicans, do we need a better mouth piece for the republicans to communicate? >> brian: in the end of the bi, the president is still campaigning, he said he wants to put a trophy in the liberal trophy case. that's what 85 billion will when you have a trillion debt. >> steve: americans tried to leave the country in better shape than they got it. we try to do better for our children and children's children. not this president. when you look at the debt and deficits he run up. he run up more debt than all of the other presidents combined and maybe the republicans should let the president go ahead and sail off of the cliff and do it for the next generation. keep in mind, somebody may have to pay the bill it may be our children and our children's children.

>> gretchen: she was there in the hospital three days or so. what is the chances that she goes back in the state and needs to be readmitted. >> hyperemesis gravidarum starts in the fifth or six week of pregnancy and gets better after the ninth week and in second trimester it absolve would but some women it can go throughout the pregnancy. the majority of women get better in the second trimester. she may be readmitted to the hospital or receive care at home. she should get better hopefully. >> gretchen: do we know what causes it? >> we don't. we don't understand the cause of hyper memis. women who have sensitive to oral contraceptives or hormones may be at risk.

dependency and we turned the program. let's be honest about it. we want to have a program to take care of the generally disabled. it is another path of dependency and entitlement culture. >> brian: we found this. so many different identified mood disabilities. instead of saying bill and sandy is down a little today. you say we have a problem here. you think it is a identification of a mood disable that we didn't want to deal with. >> yes and no. we took things and medicalized them. we put a label on them . when you put other people's money behind and tax dollars behind them, guess what, you get an epidemic . this is one of those momes and say. do we want a safety net that is targeted at the generally

misabled or creating another program for the takers in this society. it baloned to 130 billion a year and no indication it is going to slow down soon. quite frankly, the whole aproachh of the american with disabilities act. what this program is doing is saying, you don't have to work, we'll create a permanent alternative and unfortunately that means a lot of people are figuring out it is assesser to collect these checks than it is to get a job and integrate in society and learned what earned success is all about. >> steve: it could be a sign of a lowsy economy. so many people who need jobs and as you have detailed, it is relatively easy to get on the disability list. i need to feed my family and this is my last option. that's right. in a nation of moochers, part of what happens. if you are laying out money

why is this discussion not about the outrageous spending, and by the way, the waste that is going on with our government right now? that's the question john boehner, the speaker of the house has. listen to him. >> this week we made a good faith offer to avert the fiscal crisis and that offer included significant spending cuts and reforms and it included additional revenue. frankly, it was the balanced approach that the president has been asking for. now we need a response from the white house. we can't sit here and negotiate with ourselves. and if the president doesn't agree with our proposal and our outline, i think he's got an obligation to send one to the congress. a plan that can pass both chambers of congress. if you look at the plans that the white house has talked about thus far, they couldn't pass either house of the congress.

>> brian: hasn't because it's been presented before. here is one thing the president i think is banking on because he's playing his cards and it's a strategic approach. he's saying if i can divide boehner and the other house republicans, i could break this thing wide open and i could get what i need. and it turns out of all places, the "new york times," the first story says boehner has never had more fellow house support, republican house support than he has right now. they might not all agree, but they're willing to be led by him. >> steve: keep in mind, the republicans ran on -- voted for divided government. we've got a democrat. it's a status quo. the white house is controlled by democrats, as the senate and the republicans control the house. that's what the american people voted for. the president ran on hiking up taxes and the republicans ran on we're not going to allow that to happen. what's interesting, though, right now, john boehner is saying look, mr. president, you don't have to raise tax rates. you can just come up with all the dough we need or enough

financial affairs are in the hands of a bankruptcy court judge. that judge says you get this and you don't get that. >> steve: that's what they don't like because suddenly they're going to have to be a little more responsible than they've been in the past. >> this all goes back to the municipal unions. they are due to be paid eformosa pensions, very high wages, big pensions. they simply cannot meet the promises that they've made to those retirees. that has to be sorted out. a bailout doesn't sort it out. a bankruptcy does. >> steve: bailout is just a bunch of bucks in their direction. >> i'm afraid so, yes. it's good money after bad. >> gretchen: what you've been saying on the show for the last one or two years is that you believed that people would vote in part for president obama to get these types of bailouts. >> yes. and i think that's what happened. >> gretchen: but let's say that they actually file for bankruptcy. what happens to those union contracts? >> union contracts then become in play. it depends on the state constitution and the contractual

>> gretchen: for nearly 60 years, the city of santa monica, california celebrated christmas with elaborate, life size nativity scenes. but a judge recently ruled that the displays aren't allowed in public places. after a bitter fight and court battle, our next guests say they're finding ways to keep christmas alive in that city and all across america. joining me, the director of the christian defense coalition, reverend patrick mahoney and reverend gary dull who is visiting us. good morning. >> good morning. >> gretchen: how wonderful. i make a point every christmas of taking my children around my community, drive by, stop and see all of the nativity scenes. why is it so important to keep it alive? >> two reasons. the powerful message of

christmas. peace on earth, good will toward men. but also celebrating our religious tradition. the constitution promises freedom of religion. not freedom from religion. when we heard about santa monica, 59 consecutive years, we said we had to get involved. we have this project called the nativity project. we encourage individual citizens to get a permit. we found a loophole, incredible loophole in santa monica and there is going to be a nativity display there for year 60. the federal judge banned unattended displays. not live nativities like you see here. so december 8, christians and people of good will from all across southern california are coming to passion sides park and there will be a nativity scene. i have here our permit. we had this in front of the united states supreme court yesterday. this is our permit.

i would encourage anyone who is having a problem in their community, with nativity scenes, if we are allowed to have a display in front of the united states supreme court and the united states capitol, then any citizen can display the beauty of christmas, the power of christmas, the wonderful message of hope and we're work with pastor dole right now. >> gretchen: so pastor dull, tell me your story. what's going on up in altoona? >> it used to be that cities all across the city and communities would be able to put out the nativity scene without any issue whatsoever. same thing in altoona where we live and of course, somebody comes along and says you can't do it. well, we can do it because this is the united states of america. so we would like to be able to work along with them to get the proper prime ministers to see that the nativity scene is back in front of city hall. once again, to make that statement that we can do it in the united states of america. in my opinion, the nativity scene, particularly the live

nativity scene, is without a doubt one of the most clearest way to present the concept of what christmas is all about. we talk about christmas trees, the lack of the word christmas beside a tree, but the concept of the nativity scene is what christmas is all about and we believe as christians, we need to do more and more to promote that as those -- there are those who would like to stand against. >> gretchen: i always say it seems odd to me that around the christmas season that you would have to drive around and look for a in a activity scene and say hey, look, there is baby jesus way behind in the background. why shouldn't it be out front and center? i don't understand the problem. not that we're against not also honoring other religions. >> well, and that's what we're fighting against. sadly, gretchen, a small minority with a very loud voice have dominated this. but we found this incredible way, as citizens and people of goodwill, you can go get permits to do this in any city. so if you're living in altoona, toledo, miami, anywhere and the

merry christmas. meanwhile, lawmakers rushing to avoid the so-called fiscal cliff at the end of this month. a series of tax cuts and spending cuts set to kick in just 26 shopping days until the fiscal cliff. >> brian: less working days. >> steve: that's right. house republicans say there will be no deal if tax ritz go up and the obama administration says it's ready to go thelma and louise style over the cliff on january 1. if that's the case, wendell goler live at the white house with what we know is going on behind the scenes. anything happening? >> steve, the president and house speaker john boehner talked on the phone yesterday, but they agreed not to characterize their conversation. so it's unclear how much progress they made. from the outside, it does seem they've moved a bit closer with boehner now agreeing to raise tax collection from the wealthy, though not by raising tax rates. >> we've got to cut spending and i believe to put revenues on the table. the revenues we're putting on the table will come from, guess who, the rich!

there are ways to limit deductions, close loopholes, and have the same people pay more of their money to the federal government without raising tax rates which we believe will harm our economy. >> the president lobbied big business leaders yesterday with an appearance at the business round table. his aides say you can not raise enough money by phasing out deductions without causing other problems. for example, officials say eliminating the mortgage interest deduction would hurt middle class homeowners and the housing industry. and eliminating charitable giving deductions would hurt hospitals, universities and charities and phasing out those deductions for people above a certain income level wouldn't raise enough money. tim geithner says there is no alternative to ending the bush administration's upper income tax cuts. >> the administration prepared to go over the fiscal cliff? >> absolutely. again, there is no prospect to an agreement that doesn't involve those rates going up on

the top 2% of the wealthiest americans. remember, it's only 2%. >> couple of senate republicans said they're ready to let the top tax rates go up, but there is no indication the house is willing to go along. the close get to this so-called fiscal cliff, the more experts are suggesting it may be more of a slope. we'd have to slide down it a while before the economy would actually slip back into recession. steve, brian, gretchen? >> steve: north lawn of the white house, not a fiscal cliff, just a scary slope. >> brian: yes. >> gretchen: let's bring in michelle malkin. she's out in colorado where there is a lot of slippery slopes. usually people are just skiing down those. >> steve: we're falling down this one. >> gretchen: how do you react to what wendell goler said, the phone call between the president and boehner and the president laying down the gauntlet saying, unless you talk debt ceiling and raising taxes, i'm not going to actually come to the table anymore. how come he's not talking about what many americans deem to be the real problem, which is enormous spending?

be able to own a home again if i is gone through foreclosure or short sale or bankruptcy? what's the answer? >> absolutely. as a matter of fact, lenders are actually putting certain guidelines on and we're going to go over that in a few minutes so far as fha and va. i want our viewers to understand, there is life after foreclosure, bankruptcy and short sale. you will be able to own again. not only a home, but even buying cars and things like that. i have people that filed bankruptcy a year ago, they have a new car. most important thing, steve, is if you lost your home, short sale, foreclosure, bankruptcy, keep all of your consumer debts current. keep your credit cards current, keep your car payments current. that will bring those fico scores back up in 12 to 18 months and sooner. >> steve: okay. so let's talk about some of the guidelines. for instance, you just mentioned fha loan. if you are looking for something like that, what are their guidelines for bouncing back? >> here is what they say, remember, fha insures the loan. so many people think fha is a

lendser. they tonight. they insure the loan. if you have been foreclosed on, fha says they will after three years. a bankruptcy, interestingly enough, after two years. why? because they know that a chapter 7 bankruptcy, that you're not going to be able to file for years to come and most of your debt has been wiped out. there has been talk, steve, i saw a few releases a couple weeks ago that fha is actually thinking of maybe even waiving these guidelines so to make it easier to be able to insure because they recognize so many people were in the spot they're in and i hope that happens 'cause it could loosen up the market for people to be able to buy again. >> steve: absolutely, 'cause that's how we dig ourselves out of this market is more people available to buy house. you mentioned fha, what about v.a.? you say that through the veterans administration, their guidelines are actually even better for veterans than through fha. >> they are. two years.

two, short sale foreclosure, bankruptcy, two, two, two. chapter 13 bankruptcy, one year. and the whole reason behind this is they look and see, look, here is a situation happen with these people. let's try to make it available to them and make it more available so they can buy sooner because of the circumstances. by the way, steve, we're also talking about primary residentses here. they're not as lenient with investment properties. the other thing i would like to tell our viewers, for example, buying a car. i was talking to one of the big finance companies the other day that basically finances a lot of cars. they are saying that even if you lost your home to foreclosure and short sale, they're not even looking at that anymore, steve. they know what's happened in america. what they do is they break down in tears, teira, different layers and all you do is pay more of a finance charge when you go buy car, depending on the fico scores. there is life after what we've gone through. >> steve: that's great news.

>> 12 states have a zero tolerance level for pot. in washington state where marijuana is now legal, the limit is five nanograms per level. some argue it's roughly equal to alcohol. >> because we're early on in the research stage, it's difficult o determine whether or not that standard will change. similar to how the dwi standards changed. >> the problem is, how do users can test positive weeks after smoking. also what you smoke and how you smoke it affects people differently. so even experts don't know how much pot causes impairment. >> for anyone to be able to say that two hits or two dosages would give me 5 nano grams, it isn't possible to make that determination. >> so marijuana is now legal in two states and easily available in 17 others where medical marijuana is now sold. more people are now under the influence, you guys. one study found in california, on weekends, 14% of drivers are
